Cary NC Social Security Disability Attorney
Nobody likes the idea of being disabled. But unfortunately for many people disability is a fact of life. According to the Social Security Administration, a 20-year-old worker has a three in ten chance of becoming disabled prior to full retirement age. Cary NC Social Security Disability Attorney Kevin Bunn can help.
Social Security Disability (SSD) is the federal program established to provide benefits to people who are no longer able to work. Social Security Disability is insurance, not a welfare program. To qualify a person must meet strict work criteria and have paid into the system. Most people must meet both a “recent work” test” as well as a “duration of work” test. Certain blind workers only have to meet the “duration of work” test.
Social Security will initially review your application to make sure you meet basic threshold requirements, including whether you have worked enough years to qualify. If you meet the threshold requirements Social Security will send your application to the North Carolina Disability Determination Services office, where the initial decision is made in all North Carolina SSD claims. The process for determining disability can be long and difficult.
In making its decision on North Carolina SSD claims, the NC Disability Determination Services office will consider medical evidence from your doctors as well as any hospitals, clinics or institutions where you have treated, as well as a broad range of other information. They will investigate your medical condition(s), when the condition(s) began, how your condition(s) limit your activities, the results of any diagnostic tests, as well as any treatment you have received. They will also ask your doctors for information and opinions on your ability to do work related activities.
Social Security will consider you disabled if:
1) you cannot do the work you did before;
2) you cannot adjust to other work because of your medical condition(s);
3) your disability has lasted or is expected to last for at least one year or to result in death.
